Please note that this is an English translation of our “Conditions Générales de Vente”.
In the event of any discrepancy, the French version will prevail.
These general conditions define the rights and obligations of the parties in the context of the online sale of products offered by Distillerie du Vercors on the http://www.distillerie-vercors.com/ website to the consumer. Our site is intended for private individuals and not for professionals. Alcohol abuse is dangerous for your health. Drink in moderation.
General provisions – Distillerie du Vercors, which is the operator of the http://www.distillerie-vercors.com/ website, has set up the online shop to which these general conditions of sale apply. The sale of alcoholic products is reserved exclusively for persons over the age of 18 and with full legal capacity. Any order placed for a product appearing in the online shop on the http://www.distillerie-vercors.com/ website implies prior consultation and acceptance of these general terms and conditions. Consequently, you acknowledge that you are fully aware of the fact that your agreement to the content of these terms and conditions does not require a handwritten signature, insofar as you are ordering the products presented in the website shop. The quantity of products that may be ordered from the online shop is limited to 10 bottles per order. If you order more than this quantity, please contact Distillerie du Vercors by telephone on 04 28 42 01 85. Prior to your order, you certify that the acquisition of these products is not directly related to your professional activity, their acquisition being reserved for personal use. The specific rights granted to non-professional consumers would be called into question in the event that the products acquired via the website were in fact related to a professional activity. Orders may only be placed by persons legally capable of entering into contracts concerning the products offered on our website. Orders from professionals are not accepted (with the exception of corporate gifts).
Protection of minors – In accordance with article L. 3342-1 of the French Public Health Code, which stipulates that the sale of alcohol to minors is prohibited, by completing the order form you certify that you are over 18 years of age on the date of the order.
Entry into force – duration – These terms and conditions come into force on the date of validation of the order form. The present general conditions are concluded for the duration necessary for the supply of the goods and services subscribed to, until the extinction of the guarantees owed by Distillerie du Vercors.
Electronic signature – Validation of the order form constitutes an electronic signature which has the same value between the parties as a handwritten signature.
Proof of transaction – The computerised registers, kept in the computer systems of Distillerie du Vercors under reasonable conditions of security, will be considered as proof of the communications, orders and payments made between the parties. Order forms and invoices are archived on a reliable and durable medium that can be produced as proof.
Product information
- Distillerie du Vercors presents on its website http://www.distillerie-vercors.com/ the products for sale accompanied by information that enables the essential characteristics of the products purchased to be known before the final order is taken, in accordance with Article L 111-1 of the French Consumer Code.
- The offers presented by Distillerie du Vercors are only valid while stocks last.
Ordering goods and services and completing the online sale – In order to place an order, you must complete the following steps:
- Go to the http://www.distillerie-vercors.com/ website;
- Follow the instructions on the site and, in particular, the instructions for opening a customer account;
- Fill in the order form. In the event of prolonged inactivity during the connection, it is possible that the selection of goods and services chosen by the customer before this inactivity is no longer guaranteed. In this case, the customer is invited to restart their selection of goods and services from the beginning;
- Check the details of the order and, if necessary, identify and correct any errors;
- Confirm the order, the total price and the all-inclusive price;
- Follow the instructions on the online payment server to pay the all-inclusive price.
You will then receive electronic confirmation of receipt of the order without delay. Once payment has been verified, you will receive electronic confirmation of the Order. You will then receive electronic confirmation that your order has been dispatched. Delivery will be made to the delivery address indicated by the customer at the time of ordering, which may be different from the billing address. During the various stages of the order mentioned above, you undertake to respect the present contractual conditions (article 1366 of the French Civil Code). Distillerie du Vercors undertakes to honour orders only within the limits of available stocks. If the goods are not available, Distillerie du Vercors undertakes to inform the customer. However, in accordance with article L. 121-11 of the Consumer Code, Distillerie du Vercors reserves the right to refuse the order if it is abnormal, placed in bad faith or for any other legitimate reason, and in particular, when there is a dispute with the customer concerning payment of a previous order.
Prices – The prices invoiced for products are those shown on the website on the date the order is validated. These prices may differ from the prices charged in the physical shop. Distillerie du Vercors reserves the right to modify its prices at any time, but undertakes to apply the prices in force at the time of ordering, subject to availability of the products on that date. Prices are given in euros and include VAT applicable on the day of the order. Any change in the applicable VAT rate will automatically be reflected in the price of the products in the online shop. Prices do not include delivery charges, which are invoiced in addition and indicated before the order is validated. Payment in full, including delivery charges, must be made at the time of ordering. At no time may the sums paid be considered as deposits or advance payments.
Methods of payment – To pay for each order, you have a choice of all the methods of payment indicated on the order form. You guarantee Distillerie du Vercors that you have the necessary authorisations to use the method of payment chosen when validating the order form. Distillerie du Vercors reserves the right to suspend any order and any delivery in the event of refusal to authorise payment by bank card by the officially accredited organisations or in the event of non-payment. In particular, Distillerie du Vercors reserves the right to refuse to make a delivery or to honour an order from a consumer who has not paid in full or in part for a previous order, or with whom a payment dispute is in progress. Distillerie du Vercors may implement an order verification procedure designed to ensure that no person uses another person’s bank details without their knowledge. As part of this verification, the customer may be asked to send Distillerie du Vercors a copy of an identity document and proof of address. The order will not be validated until we have received and checked the documents received. In the event of payment by cheque issued by a non-French bank or a bank not located in France, any resulting bank charges will be borne by the purchaser. No payment data is stored on our site.
Delivery times and product availability – Except in cases of force majeure or when the online shop is closed, which will be clearly announced on the home page of the http://www.distillerie-vercors.com/ website, the estimated delivery times will be as follows, subject to stock availability:
- France: mainland France: estimated delivery time 5 working days
- Corsica: estimated delivery time of 6 working days.
Estimated delivery times run from the date on which the order is registered, i.e. the date of the order confirmation e-mail. In the event of delay, Distillerie du Vercors cannot be held liable for any reason whatsoever. Consequently, no compensation of any kind whatsoever may be claimed by the customer from Distillerie du Vercors. In the event of unavailability of the product ordered, you will be informed as soon as possible and will have the option of cancelling your order. You will then have the choice of requesting either a refund of the sums paid within 30 days of their payment, or an exchange of the product.
Terms of delivery – The delivery territory is limited to mainland France, including Corsica and Monaco. Products ordered are delivered by the method specified on the order form. Distillerie du Vercors reserves the right to impose transport by specialised carrier in cases where the size and weight of the products ordered require such transport. No deliveries will be made to campsites, hotels, post office outlets or post boxes. Products are delivered to the address indicated by the customer on the order form, and the customer must ensure that this address is correct. Any parcel returned to the sender because of an incorrect or incomplete delivery address will be re-sent to the address corrected by the customer at their expense. You may request that an invoice be sent to the billing address and not to the delivery address, by validating the option provided for this purpose on the order form.
Delivery problems due to the carrier – You must indicate on the delivery note, in the form of handwritten reservations accompanied by your signature, any anomaly concerning the delivery (damage, missing product compared with the delivery note, damaged package, broken products, etc.). This verification is considered to have been carried out once the buyer, or a person authorised by the buyer, has signed the delivery note. You must also confirm these reservations to the carrier by registered post within two working days of receiving the item(s) at the latest, and send a copy of this letter by email or post to : Distillerie du Vercors – 1340 route du camp d’Ambel – 26190 Saint-Jean-en-Royans, FRANCE If the products need to be returned to us, a request for their return must be made within 7 days of delivery. Any claim made after this deadline will not be accepted. Returns will only be accepted for products in their original condition. If, at the time of delivery, the original packaging is damaged, torn or open, you must check the condition of the items. If they have been damaged, you must refuse the parcel and note a reservation on the delivery note (parcel refused because opened or damaged).
Delivery errors
- You must notify Distillerie du Vercors on the day of delivery, or at the latest on the first working day following delivery, of any claim of error in delivery and/or non-conformity of the products in kind or in quality compared to the information given on the order form. Any claim made after this deadline will be rejected.
- This claim may be made to Distillerie du Vercors:
- In priority by telephone on 04 28 42 01 85, Tuesday 2pm to 6pm and Wednesday to Friday 10am to 12pm and 2pm to 6pm.
- By sending an email to info@distillerie-vercors.com, specifying the references of the order (number and date).
- Any claim not made in accordance with the rules set out above and within the time limits set will not be taken into account and will release Distillerie du Vercors from any liability to the customer.
- On receipt of the claim and after verification, Distillerie du Vercors will exchange the product(s) concerned and will inform you by e-mail or telephone.
- In the event of a delivery or exchange error, any product to be exchanged or reimbursed must be returned to Distillerie du Vercors as a whole and in its original packaging, within 5 working days of receipt of the incorrect product, by registered Colissimo, to the following address: Distillerie du Vercors – 1340 route du camp d’Ambel – 26190 Saint-Jean-en-Royans, FRANCE.
- To be accepted, all returns must be notified in advance to the Distillerie du Vercors Customer Service Department.
- Distillerie du Vercors will bear the cost of the return, except in the event that the product taken back does not correspond to the original declaration made by you on the return form.
Product guarantee – Our products are produced, packaged and dispatched with the greatest care. The present provisions do not deprive the customer of the legal guarantee which obliges the professional seller to guarantee the customer against all the consequences of hidden defects in the item sold.
Right of withdrawal – In accordance with article L.221-18 of the French Consumer Code, you have 14 calendar days from the date of the order to exercise your right of withdrawal and return your item intact and complete in its original packaging, by registered post or Colissimo with tracking. You may request a refund, a credit note or an exchange. You must first inform Distillerie du Vercors :

Only products returned in their entirety and in perfect condition for resale will be taken back. This right of withdrawal is exercised without penalty, it being understood that the cost of returning the goods is borne by the customer. In the case of an exchange, the new shipment will be at the customer’s expense. Any product which has been damaged, or whose original packaging has been damaged, will not be reimbursed or exchanged.
Specific conditions for Whisky Workshops – Vouchers for invitations to a Whisky Workshop are valid for one year from the date of issue. Failure to attend a Whisky Workshop or cancellation less than 7 days before the date of the Whisky Workshop will result in the definitive cancellation of the voucher. We reserve the right to cancel a Whisky Workshop if the minimum number of participants is not reached 7 days before the date of the Whisky Workshop. In this case, you will be offered another date. Vouchers are neither exchangeable nor refundable.
Force majeure – Neither party will have failed in its contractual obligations if their performance is delayed, hindered or prevented by a fortuitous event or force majeure. Force majeure is defined as any event or circumstance which is irresistible, external to the parties, unforeseeable, unavoidable, beyond the control of the parties and which cannot be prevented by the parties, despite all reasonable efforts. The party affected by such circumstances will notify the other within ten working days of becoming aware of the circumstances. The two parties will then meet, within a period of one month, unless this is impossible due to force majeure, to examine the impact of the event and agree the conditions under which performance of the contract will continue. If the case of force majeure lasts for more than three months, these general terms and conditions may be terminated by the injured party. The following are expressly considered to be cases of force majeure or fortuitous events, in addition to those usually accepted by the case law of French courts and tribunals: blockage of means of transport or supplies, earthquakes, fires, storms, floods, lightning, stoppage of telecommunications networks or difficulties specific to telecommunications networks external to customers.
Transfer of ownership – Transfer of risks – Distillerie du Vercors expressly reserves ownership of the Products delivered until full payment of their price in principal and interest, whatever the date of delivery of the said Products. The simple handing over of a proof of payment does not constitute payment. The above provisions do not prevent the transfer to the customer of the risks of loss or deterioration, which takes effect as soon as the products are handed over to the carrier. In the absence of full payment, Distillerie du Vercors will be entitled to demand the return of the products delivered. Any costs that may be incurred for this return will be charged to the customer.
Partial non-validation – If one or more stipulations of these general terms and conditions are held to be invalid or declared as such in application of a law, regulation or following a final decision by a competent court, the other stipulations will retain all their force and scope.
Entirety – These general terms and conditions express the entirety of the obligations of the parties. In this sense, the customer is deemed to accept without reservation all the provisions set out in these general terms and conditions. No general or specific condition appearing in documents sent or handed over by the customer may be incorporated into these terms and conditions, insofar as such documents are incompatible with these terms and conditions.
Disputes Applicable law – All the clauses contained in these general terms and conditions of sale, as well as all the purchase and sale transactions referred to herein, shall be subject to French law. This applies to both substantive and formal rules. In the event of a dispute or claim, the customer should first contact Distillerie du Vercors to try to find an amicable solution. Complaints or disputes will always be received with attentive benevolence, good faith always being presumed in those who take the trouble to explain their situation. The European Commission has set up a platform for out-of-court dispute resolution. This offers consumers the possibility of settling disputes concerning an online order, initially without the intervention of a judge. This dispute resolution platform can be found at https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=FR. You can also contact the consumer ombudsman by post at the following address: Médiateur du net 6, rue Déodat de Séverac, 75017 Paris.
Information Technology and Civil Liberties – The information requested from the customer is necessary for the processing of the order and may be communicated to the contractual partners of Distillerie du Vercors involved in the execution of this order. The customer may write to Distillerie du Vercors, whose contact details are given in the confidentiality charter appearing on the website, to oppose such communication, or to exercise their rights of access and rectification with regard to information concerning them and appearing in the files of Distillerie du Vercors under the conditions laid down by the law of 6 January 1978.
Intellectual property – All elements of the http://www.distillerie-vercors.com site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks, designs and models, patents or databases. They are the exclusive property of Distillerie du Vercors or the legal entities or individuals holding their rights, and may not be reproduced in any form whatsoever without the express written permission of Distillerie du Vercors.
